General terms and conditions of sale

Article 1 – Purpose and nature

COLOMBE MARCIANO organises the present training course in application of Book IX of the French Labour Code, in particular articles L6313-1 to L6313-11 and articles L6343-1 to L6343-4. 

The present general conditions apply to training services provided by the company Colombe Marciano in the form of inter-company training courses. Any signature of a training proposal and course agreement by COLOMBE MARCIANO implies unreserved acceptance of these general terms and conditions of sale.


Article 2 – Registration procedures

Orders for training from COLOMBE MARCIANO may be sent by any means. COLOMBE MARCIANO will send the applicant a training agreement which must be returned completed and signed. Only this training agreement will be deemed to be a commitment on the part of COLOMBE MARCIANO. 

Then, any enrolment will only be considered definitive on receipt of the said signed agreement. The trainee’s place will be reserved on receipt of the deposit of 25% of the total cost of the training course AND the signed agreement.


Article 3 – Invitation to attend

COLOMBE MARCIANO will send an invitation to attend the course, giving the address and times of the course, 2 weeks before the date of the session.


Article 4 – Level required and suitability

At the beginning of the course, COLOMBE MARCIANO ensures that the training needs and level of trainees correspond to the training courses it offers.

Next, any training course that a participant has begun to attend is due in full.


Article 5 – Rates and billing

Fees are fixed for the current year and are expressed exclusive of tax. They are increased by the VAT rate in force on the date of the course. Prices quoted for training courses are for the complete course and are also quoted per day.

Then, prices for inter-company training courses include teaching aids (course materials, documents given to trainees, etc.). These documents are for the exclusive and personal use of the participant.

Any late payment will be subject to penalties equivalent to 2 times the legal interest rate in force on the due date for payment of the invoice concerned. No discount will be granted for payment before the due date.


Next, a deposit of 25% of the course price may be requested at the time of enrolment. The balance must be paid within 7 days of the start of the course. In the event of payment by the Customer’s OPCO, it is the Customer’s responsibility to apply for funding before the start of the course. The financing agreement must be communicated at the time of registration. 

In the event of partial coverage by the OPCO, the difference will be invoiced directly to the Customer. If the funding agreement from the OPCO does not reach COLOMBE MARCIANO the day before the training course, COLOMBE MARCIANO reserves the right to invoice the customer for the full cost of the training course.


In the event of payment being made by an OPCO (organisme Paritaire Collecteur Agréé), it will be the responsibility of the beneficiary to ensure payment by the organisation they have designated.

Then, it is the customer’s responsibility to also apply to any other funding body for payment in accordance with the terms and conditions of each body.


Article 6 – Cancellation policy

Any cancellation of enrolment by the Customer must be notified to COLOMBE MARCIANO in writing. In the event of cancellation of the training course by the Customer less than 7 days before the start of the training course, the following penalties will have to be paid by the customer company, it being specified that these sums cannot be reimbursed or covered by the OPCO or other funding body: – all amounts already paid will be retained by COLOMBE MARCIANO in the event of absence, trainees will be offered a new training proposal for the next session of the course concerned.

Any training course which a participant has started to attend is due in full.


Article 7 – Liability

COLOMBE MARCIANO undertakes to do its utmost to ensure the success of the training courses. The agency may not be held liable in the event of damage or loss caused to third parties or to the premises and equipment made available by COLOMBE MARCIANO.

The agency cannot be held liable in the event of damage or injury being caused to third parties or to the premises and equipment made available by COLOMBE MARCIANO but used by the trainees during the training courses.
